Welcome to PTE Exam Practice. These Terms and Conditions ("Terms") govern your use of the PTE Exam Practice mobile application ("App") operated by SwiftSoft ("we," "us," or "our").

By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Description of Service

PTE Exam Practice is an educational mobile application designed to help users prepare for the Pearson Test of English (PTE) Academic exam. The App provides:

• Practice questions for all PTE exam sections (Speaking, Writing, Reading, and Listening)
• Full-length mock tests simulating the actual PTE exam experience
• AI-powered scoring and feedback on your responses
• Progress tracking and performance analytics

2. Subscription and Payments

The App offers both free and premium subscription options:

• Free Access: Limited access to practice questions and features
• Premium Subscription: Full access to all practice materials, mock tests, and advanced features

Subscriptions are processed through Apple App Store or Google Play Store. By purchasing a subscription:

• Payment will be charged to your App Store or Play Store account upon confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions through your App Store or Play Store account settings

3. Refund Policy

Refunds are handled according to the policies of the Apple App Store or Google Play Store. We do not directly process refunds. If you believe you are entitled to a refund, please contact the respective app store's support.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Share, distribute, or reproduce any content from the App without authorization
• Attempt to reverse engineer, decompile, or disassemble the App
• Use automated systems or software to extract data from the App
• Share your account credentials with others
• Interfere with or disrupt the App's functionality or servers
• Upload or transmit viruses, malware, or other malicious code

5. Intellectual Property

All content in the App, including but not limited to text, graphics, logos, audio files, images, and software, is the property of SwiftSoft or its content suppliers and is protected by international copyright laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial educational purposes only.

6. User Content

When you submit recordings, written responses, or other content through the App:

• You retain ownership of your content
• You grant us a license to use, process, and analyze your content for providing our services and improving the App
• Your audio recordings and written responses may be processed by AI systems for scoring purposes

7. AI Scoring Disclaimer

Our App uses artificial intelligence to provide estimated scores and feedback on your practice responses. Please note:

• AI-generated scores are estimates and may not reflect actual PTE exam scores
• The scoring system is designed for practice and learning purposes only
• We do not guarantee that your actual PTE exam results will match the scores provided by our App

8. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "as is" without warranties of any kind
• We do not guarantee uninterrupted, error-free, or secure access to the App
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim

9. Indemnification

You agree to indemnify and hold harmless SwiftSoft, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

10. Termination

We reserve the right to:

• Suspend or terminate your access to the App at any time for violations of these Terms
• Discontinue the App or any features with or without notice

Upon termination, your right to use the App will immediately cease.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or via email. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
